1. Acceptance of Terms

Welcome to WildfireX. These Terms & Conditions ("Terms") govern access to and use of the website https://www.wildfirexdefense.com, the WildfireX mobile applications for iOS and Android, MAX AI, connected wildfire-defense software, and related digital services (collectively, the "Services") provided by WildfireX Inc. ("WildfireX," "Company," "we," "our," or "us").

By accessing or using the Services, you agree to these Terms and our Privacy Policy.

If you do not agree, you should discontinue use of the applicable Services.

Additional written agreements may govern the purchase, installation, maintenance, warranty, or servicing of WildfireX equipment. Those agreements will control the specific matters they address if a conflict arises with these general Terms.

2. Description of Services

WildfireX develops and supports technology designed to assist property owners with wildfire awareness, preparedness, and the operation of compatible exterior wildfire-defense systems.

Available features may include:
· Wildfire incident maps and location-based alerts.
· Property-specific wildfire risk information.
· Publicly available evacuation and emergency-information feeds.
· MAX AI informational guidance.
· Push notifications and system-status information.
· Remote activation and deactivation of compatible wildfire-defense equipment.
· Connected sprinkler, pump, valve, and water-source controls.
· Optional property-camera viewing and related features.
· Customer support and equipment-related software services.

Some informational features may be available without purchasing equipment.

Remote-control and equipment-specific functionality requires compatible installed hardware, authorized access, and any applicable service arrangements.

Features may vary by platform, location, account status, equipment configuration, and service availability.

3. Important Safety and Emergency Disclaimer

WILDFIREX IS NOT AN EMERGENCY RESPONSE AGENCY, FIRE DEPARTMENT, EVACUATION AUTHORITY, OR SUBSTITUTE FOR 911.

WildfireX products and Services are intended to supplement wildfire preparedness and property-defense measures. They do not eliminate wildfire risk or guarantee protection of any structure, property, or person.

Wildfire behavior is unpredictable. Embers, radiant heat, direct flame exposure, weather conditions, equipment availability, and numerous other factors may affect outcomes.

WildfireX does not guarantee that its Services will detect every fire, deliver every warning, prevent property damage, or save a structure during a wildfire.
Always follow official evacuation orders and emergency instructions. Never delay evacuation to activate, monitor, adjust, or retrieve WildfireX equipment.
In an emergency, call 911 where appropriate and follow directions from authorized emergency personnel.

4. Wildfire Information and Third-Party Data

WildfireX may display information obtained from government agencies, public databases, mapping services, weather providers, and other independent sources.

Information may include wildfire incident locations, approximate distances, acreage, containment estimates, risk indicators, evacuation information, and related conditions.

Third-party data may be delayed, incomplete, inaccurate, unavailable, or subsequently revised.

Distances and risk indicators may be estimates rather than real-time measurements of fire movement or danger.

WildfireX does not control the availability or accuracy of third-party data and does not guarantee that alerts will arrive before a dangerous condition develops.
Users should independently consult official agencies, including applicable fire authorities, emergency management agencies, and local evacuation-information systems.

References to government information sources do not imply government endorsement or affiliation.

5. Max AI — Artificial Intelligence Disclaimer

MAX AI is an informational and decision-support feature designed to assist with wildfire awareness, general preparedness, and interpretation of available information.

MAX AI may generate responses using automated systems, third-party information, and artificial intelligence.

AI-generated responses are not guaranteed to be accurate, complete, current, or appropriate for a particular property or emergency.

MAX AI does not replace instructions from firefighters, emergency management agencies, licensed engineers, licensed contractors, or other qualified professionals.

Users must not rely exclusively on MAX AI to decide whether to evacuate, remain at a property, enter a wildfire-affected area, or take other potentially dangerous actions.

WildfireX makes no guarantee that MAX AI predictions, recommendations, or descriptions will correspond to actual wildfire conditions.

6. Remote Activation and Connected Equipment

Authorized customers may use the WildfireX application to issue commands to compatible equipment, including exterior sprinkler zones, valves, pumps, or other supported system components.

Remote activation requires an intentional user command. An alert, risk indicator, or AI recommendation does not, by itself, constitute confirmation that the wildfire-defense system has activated.

Remote commands depend on factors that may include:
· Available electrical power and backup-power capacity.
· Internet, cellular, Wi-Fi, and network connectivity.
· Functional controllers, communication equipment, and software.
· Pump, valve, and sprinkler operating conditions.
· Adequate water supply, water pressure, and hydraulic capacity.
· Proper installation, testing, and ongoing maintenance.
· Applicable equipment settings and operating restrictions.

A command appearing as sent, acknowledged, or activated in the application does not necessarily establish that water is physically flowing through all intended components.

Users should not assume successful operation without appropriate confirmation.

System activation may consume water, increase operating costs, or create water-related consequences depending on equipment and property conditions.
WildfireX is not responsible for failures arising solely from circumstances outside its reasonable control, except where applicable law or an enforceable written agreement provides otherwise.

7. No Guarantee of Wildfire Protection

WildfireX systems are designed to reduce certain vulnerabilities through strategically applied exterior water coverage and connected control technology.
Actual effectiveness depends on the wildfire event, property conditions, system design, installation, available utilities, water supply, maintenance, and other variables.

No exterior sprinkler or wildfire-defense system can provide absolute protection.

WildfireX does not warrant that use of its technology will prevent ignition, stop a wildfire, prevent the loss of personal property, or eliminate the need to evacuate.

Nothing in these Terms modifies any express warranty or other legal right provided under a separate written agreement or applicable law.

8. User Responsibilities

Users agree to:

1. Provide accurate and current account and property information.
2. Use equipment controls only for properties and systems they are authorized to operate.
3. Maintain reasonable security over passwords and account access.
4. Keep compatible devices, connectivity, and software reasonably up to date.
5. Follow applicable equipment instructions and recommended maintenance procedures.
6. Arrange required inspections, servicing, and repairs through appropriately qualified persons.
7. Maintain available water and electrical resources consistent with applicable system requirements.
8. Avoid unauthorized modifications, unsafe operations, or interference with equipment.
9. Comply with relevant laws, safety instructions, and official emergency orders.
10. Notify WildfireX promptly of suspected unauthorized account access or significant software issues.

Users must exercise reasonable judgment when operating physical equipment remotely.

We may suspend or restrict access when reasonably necessary to address fraud, security threats, unauthorized activity, or material violations of these Terms, subject to applicable law and agreements.

10. Cameras and Optional Services

Optional camera functionality may be available for compatible installed equipment.Camera access, recording, subscriptions, and related capabilities depend on the equipment and services selected by the customer.Customers are responsible for using cameras lawfully, respecting the privacy of others, and complying with applicable recording and surveillance requirements.

Unless explicitly established in a separate written agreement, camera functionality does not constitute professional security surveillance, continuous monitoring, or an emergency-response commitment.

The ability to view a camera feed does not guarantee that the feed will remain continuously available or accurately reflect all property conditions.

11. Critical Alert Notifications and Support

WildfireX may offer supplemental features that notify authorized personnel when certain critical app alerts remain unacknowledged.

These features are dependent on applicable configurations, technology availability, and operational circumstances.

Such notifications do not establish an obligation to monitor every incident, contact every customer, determine whether a person is safe, dispatch emergency personnel, or activate equipment on a customer's behalf.

WildfireX does not provide continuous emergency monitoring unless expressly stated in a separate written agreement describing that service.
Users remain responsible for their personal safety and for complying with official emergency instructions.

12. Purchases, Installation, and Fees

Equipment purchases, professional installation, and certain ongoing technology services may require separate payment arrangements and written agreements.

The applicable proposal or executed agreement will describe relevant pricing, payment schedules, installation responsibilities, warranties, and service terms.
Where installation is performed by a separate licensed contractor, that contractor's written agreement governs the contractor's designated work and obligations.

Free application features do not include equipment purchases, installation, or paid technical support unless expressly stated.

Additional camera or technology-support services may be subject to separately disclosed fees and cancellation terms.

These Terms do not independently authorize recurring charges that have not been disclosed and agreed to under an applicable purchase or service arrangement.

13. Service Availability, Updates, and Changes

WildfireX may update, maintain, modify, or improve its software and Services.

Temporary interruptions may occur because of maintenance, infrastructure failures, third-party outages, network interruptions, security events, or other circumstances.

WildfireX does not guarantee uninterrupted, error-free, or universally available operation.

Where commercially reasonable and appropriate, WildfireX may provide information about significant changes affecting paid functionality, consistent with applicable agreements and law.

· Access accounts, equipment, or systems without authorization.
· Attempt to defeat application security measures.
· Interfere with or disrupt WildfireX infrastructure.

· Use the Services to violate applicable law or endanger others.
· Reproduce or commercially exploit proprietary content without authorization.

WildfireX may take reasonable measures to address prohibited activity, consistent with applicable law.

16. Third-Party Services

The Services may depend on outside providers for hosting, communications, weather, wildfire information, mapping, authentication, notifications, or other functions.

Such services may be subject to independent terms and technical limitations.

WildfireX does not control every aspect of independent third-party infrastructure or information.

Nothing in these Terms excludes responsibility that cannot lawfully be disclaimed.

17. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, FREE INFORMATIONAL FEATURES, AND DIGITAL SERVICES NOT SUBJECT TO A SEPARATE EXPRESS WARRANTY ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WILDFIREX DISCLAIMS IMPLIED WARRANTIES TO THE EXTENT LAWFULLY PERMITTED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

THESE DISCLAIMERS DO NOT OVERRIDE EXPRESS WARRANTIES CONTAINED IN SEPARATELY EXECUTED AGREEMENTS OR RIGHTS THAT CANNOT LEGALLY BE EXCLUDED.

18. Limitation of Liability

To the fullest extent permitted by applicable law, WildfireX shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use or inability to use the digital Services, including lost profits, loss of data, or other consequential losses.

Wildfire-related damage may result from conditions beyond the control of any software or property-defense technology.

For claims arising solely from free website or application features, WildfireX's aggregate liability shall not exceed US $100, to the extent such a limitation is enforceable under applicable law.

Liability relating to purchased equipment, installation, warranties, or paid services will be governed by the relevant written agreements and applicable law.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, statutory rights, or other matters to the extent such exclusion or limitation is prohibited by applicable law.

19. Indemnification

To the extent permitted by applicable law, users agree to indemnify and hold WildfireX harmless against third-party claims, reasonable expenses, and liabilities arising from their unlawful misuse of the Services, unauthorized operation of another person's equipment, or material violation of these Terms.

This provision does not require users to indemnify WildfireX for the Company's own negligence, wrongful conduct, or other liability that cannot lawfully be transferred.

20. Privacy and Account Deletion

Use of the Services is subject to the WildfireX Privacy Policy:
https://www.wildfirexdefense.com/privacy-policy

Users may submit eligible privacy or account-deletion requests using the methods stated in that Policy or through:
https://www.wildfirexdefense.com/delete-account

Deleting an account may terminate the ability to access remote controls or other authenticated features.

Account deletion does not independently cancel equipment warranties, separate contracts, or existing financial obligations.

21. Termination and Suspension

Users may discontinue use of the Services at any time.

WildfireX may suspend or terminate digital-service access where reasonably necessary for security, legal compliance, material breach, or other lawful reasons, subject to applicable service agreements and consumer protections.

Termination does not eliminate obligations or rights that legally survive termination.

22. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Unless mandatory law provides otherwise, disputes concerning these Terms may be brought before courts of competent jurisdiction in Riverside County, California.

Nothing in this section deprives consumers of mandatory rights or protections available under applicable law.

23. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain effective to the extent permitted by law.

These Terms and the Privacy Policy govern general use of the digital Services. Separate executed purchase, installation, warranty, and service agreements continue to govern the particular matters addressed in those agreements.

Failure to enforce a provision does not constitute a waiver of the right to enforce it later.

24. Modifications

WildfireX may revise these Terms to reflect changes in Services, business practices, or applicable legal requirements.

The updated version will be posted on our website with a revised effective or last-updated date.
Where required, we will provide additional notice or obtain consent before changes take effect.
